| Your signature below is an agreement that (1) all information submitted is true; (2) participant fees are non-refundable; (3) you will indemnify and hold harmless the Downtown Business Association of Bismarck against any and all liabilities that may arise as a result of your participation in the Downtowners Rip-Roarin’ Ribfest Road Races; (4) participation in a road race is a potentially hazardous activity; (5) you are medically able and properly trained; (6) you will abide by the race officials decisions for safe completion of the event; (7) you assume all risks associated with participating in this event including buy not limited to: falls, contact with other participants, effects of weather including high heat, humidity and rain, traffic, conditions of the road, all such risks being known and appreciated by yourself. Having read this waiver, and knowing these facts, and in consideration of your accepting my entry, I, for myself and anyone entitled to act on my behalf, waive and release the Downtown Business Association of Bismarck, its directors, officers, and staff, the city of Bismarck and its employees, and all sponsors, their representatives and successors from all claims or liabilities of any kind arising out of my participation in this event even though that liability may arise out of negligence or carelessness on the part of the persons named in this waiver. I grant permission to all of the foregoing to use any photographs, motion pictures, recordings, or any other record of this event. |
